Terms of use

By using GigRally you agree to these terms. They are written to be read: if anything is unclear, ask us.

The service

GigRally helps bands and crews see who is available on which dates. It shows what members have told it; it does not guarantee that anyone will turn up. Bookings, fees and arrangements between band members, venues and companies are between them, not with us.

Your account

  • You sign in with a one-time link sent to your email. Keep your email account secure: anyone who can read it can sign in as you.
  • Give your real name or the name your band knows you by, and keep your email address current.
  • You must be 16 or older, or have a parent or guardian’s permission.
  • You can close your account at any time from the Account page.

Bands, owners and admins

Each band has one owner, who can make other members admins. Owners and admins can invite and remove members, book events and change band settings. The owner is responsible for the band and must hand the band on, or delete it, before leaving. Members’ dates for a band are deleted 30 days after they leave it.

Acceptable use

Don’t use GigRally to harass anyone, to send spam, to impersonate someone, to break the law, or to try to get at data that isn’t yours. Don’t interfere with the service or try to get around its limits. We may suspend an account that does.

Early access

  • GigRally is in early access. You are using it because we gave you, or your band, an early access link.
  • New bands are started from an early access link. Anyone can join an existing band from that band’s own invite link.
  • Because it is early, things may change, move or occasionally break. Please tell us when they do — that is the point of early access.

If you use GigRally for business

If you are using GigRally for the purposes of a business (for example, a working band or a production company), you agree that the Consumer Guarantees Act 1993 does not apply, as allowed by section 43 of that Act, and that the Fair Trading Act 1986 sections 9, 12A, 13 and 14(1) do not apply, as allowed by section 5D, because that is fair and reasonable between businesses. Nothing in these terms limits your rights as a consumer if you are not using GigRally for business.

Availability and changes to the service

We work to keep GigRally running and your data backed up, but we cannot promise it will always be available or error-free. We may change or improve features. If we ever close GigRally, we will give at least 30 days’ notice and a way to download your data.

Liability

GigRally is provided as it is during early access. To the extent the law allows, we are not liable for any loss from using it, such as a missed gig or lost income.

Ending

You can stop using GigRally and close your account at any time. We may close an account that breaks these terms, after telling you why where we reasonably can.

Changes to these terms

If we change these terms in a way that matters, we will tell you by email or in the app at least 30 days before the change applies. Continuing to use GigRally after that means you accept the new terms.

Law

These terms are governed by New Zealand law, and New Zealand courts have jurisdiction.
